Terms of Service

Overview

This policy is designed to protect the best interests of Modern Advisors and its customers as a whole. We reserve the right to suspend or cancel a customers access to any or all services provided by us if it is deemed that the account has been inappropriately used. All services are intended for the end user only and may not be subleased, sold or given to third parties without the expressed written consent of Modern Advisors.
 
Payments and Fees

Modern Advisors is authorized to charge the clients credit card on the anniversary of the clients original signup date each month according to the current account pricing. Modern Advisors is also authorized to charge the client for any account add-ons requested by the client. If a clients credit card is declined for any reason, the client will be notified by email. The client will have 10 days to provide a valid credit card or his/her account will be suspended. If the account is deactivated for more than 20 days, the account will be deleted from the server and the client will need to sign up for a new account. Modern Advisors has a right to charge late fees at a rate of $5 or 1.5%, whichever is greater. After a 60 day period, your invoice will be sent to collections. A $30 returned check fee will be assessed to any check payments resulting in an NSF error due to the clients fault.

Cancellations
There is a 10-day cancellation notice required before closing your account. Failure to comply with this notice will result in further billing activity for the following billing period.

Guarantee

If you are not satisfied with the service that you are receiving from our company, we will refund payment for any services which have not been completed in a timely matter, and for any service which is not functioning properly. If you present us with a claim, we ask that you provide us with a reasonable amount of time to rectify the issue presented to us, to allow for the specified service(s) to function properly. In the event that we correct the issue(s) presented, no refund will be issued. We do not provide refunds on any licenses purchased from Modern Advisors, or any subsidiaries.

Refunds

Modern Advisors does not offer a money back guarantee on any licenses purchased on our website. We do carry a satisfaction guarantee, if we are unable to correct any issues brought to our attention, a refund will be issued for the services which do not function properly. We do not refund payments because you decide that you do not like the look/feel of the final product. You are responsible to utilize a free trial offered by our software vendors. If you decide that the product is not right for you, that is your responsibility.

 Choice of Law/Venue

This Agreement will be construed and enforced in accordance with the laws of the State of Maryland, Baltimore County. The venue for any action, dispute or proceeding with respect to this Agreement and any matter related to Modern Advisors will be in the State of Maryland, Baltimore County.

Disclaimer

Modern Advisors will not be held responsible for any damages you or your business may suffer while using our service. Modern Advisors makes no warranties of any kind, expressed or implied, for services rendered. Modern Advisors disclaims any warranty or merchantability or fitness for a particular purpose. Modern Advisors assumes no liability for disruptions or improper operation of its equipment or software for any reason, including, but not limited to, vandalism, theft, phone service outages, Internet disruptions, human error, or any other causes in the nature of "Acts of God" or force of nature. Modern Advisors will not be responsible for consequential damages or punitive or exemplary damages under any circumstances. In no case will the client be entitled to recover damages from Modern Advisors.

Term

The term of this agreement will continue until a notice of cancellation by Modern Advisors or the client is given, or until terminated under other provisions of this Agreement. Modern Advisors reserves the right to terminate this agreement without cause upon notification to the client. Modern Advisors may further terminate this agreement immediately with notice at any time the client breaches any part of this agreement, or if any program or facility used by Modern Advisors to implement this agreement is disrupted or terminated for any reason.
